These terms are the agreement between you and Eureka Studios Limited for the iPhone app MomentCam 15
(on the App Store as "MomentCam 15th Anniversary", previously "MomentCam Light"). Effective date:
October 15, 2026. They replace the terms dated May 25, 2018.
If you use the app in mainland China, the mainland China terms apply to you instead.
The short version
By using the app, you agree to these terms. If you do not agree, please do not use it.
You may use the app for your own personal, non-commercial purposes. You must be at least 13.
VIP is sold through Apple as a monthly or yearly subscription, or as a one-time Lifetime purchase.
Subscriptions renew automatically until you cancel them in your iPhone's Settings. A free trial, if offered,
turns into a paid subscription unless you cancel at least 24 hours before it ends. The price is always shown before you buy.
The app is provided "as is". Our liability is limited, as explained in section 10.
Hong Kong law applies. How we handle your information is in our Privacy Policy.
1. Who we are and what these terms cover
The app is developed and published by Eureka Studios Limited, Rm 902, 9/F, Fu Fai Commercial Building,
27 Hillier Street, Sheung Wan, Hong Kong ("we", "us").
These terms cover the app, the online services it uses and our website (together, the "services"). You accept them as they are,
together with any rules or policies we publish on our website for the services.
2. Who can use the app
The services are only for people who are at least 13 years old. We do not aim the app, the services or the website at children
under 13, and we do not knowingly collect information from them.
If you are under 13, you must tell us.
We may refuse the services to anyone, and change who can use them, at any time.
This section does not apply where the law does not allow it, and in those places the right to use the services is withdrawn.
3. Your licence to use the app
As long as you follow these terms, you may use the app and the services for your own non-commercial
purposes only, and only in the ways the app allows.
The app may include code from third parties. Where we license that code to you, we do so under these terms; any notices for it
are for your information only. Third-party scripts that the app links to or calls are licensed to you by their owners, not
by us.
4. Using the app responsibly
You use the services at your own risk and are responsible for what you do with them.
Do not use the services in any unauthorised way, for example by trying to get into our systems or by overloading our network.
Do not use the services to harass, abuse, stalk, threaten or defame anyone, or to infringe or violate anyone's rights. We are
not responsible for such use by you, or for what happens to you because of someone else's use.
You are responsible for following the laws that apply to you.
You may find content that you consider offensive, indecent or objectionable. We are not liable to you for such content.
You may not use, export or re-export the app except as the laws of the country where you got it allow.
5. Our services and changes to them
We may change, suspend or remove any part of the services, or stop access to them, at any time and without notice.
Some features, such as the Realistic look, depend on our servers and have daily limits shown in the app. How the Realistic look
uses your photo is explained in the Privacy Policy.
6. VIP subscriptions and purchases
What you can buy
MomentCam VIP, monthly: an auto-renewing subscription that renews every month.
MomentCam VIP, yearly: an auto-renewing subscription that renews every year. It may come with a free trial.
Lifetime: a one-time purchase. It is not a subscription and does not renew.
VIP currently includes HD saves without a watermark, every VIP design, and every expression and look for your avatars, including
more Realistic upgrades each day. The subscription screen shows what is included and the current price, in your currency, before
you buy.
Payment and automatic renewal
Purchases are made through Apple's App Store, and Apple's terms for in-app purchases also apply.
Payment is charged to your Apple Account when you confirm the purchase.
Your subscription renews automatically for the same length of time unless you turn off auto-renew at least
24 hours before the end of the current period.
Your Apple Account is charged for the renewal within the 24 hours before the current period ends, at the price you agreed to
when you subscribed. If the price changes, Apple tells you in advance and, where required, asks you to agree.
Free trials
If a free trial is offered, its length and the price that follows are shown before you start it.
At the end of the trial, it turns into a paid subscription automatically unless you cancel at least 24 hours
before the trial ends.
If you buy a subscription during a free trial, any unused part of the trial ends.
Cancelling and refunds
You can manage or cancel your subscription at any time in your iPhone's Settings → [your name] →
Subscriptions. Deleting the app does not cancel a subscription.
Cancelling stops the next renewal. You keep VIP until the end of the period you have already paid for. The current period
cannot be cancelled part-way.
We do not give prorated refunds for the unused part of a period. Refunds are handled by Apple under Apple's own terms
(reportaproblem.apple.com).
To get VIP back on a new or reinstalled device with the same Apple Account, tap Restore in the app.
7. Your information
By using the app, you agree that we may collect and use technical information about your device, system and app software to
improve the app and the services. All of this, and how the Realistic look uses your photo, is explained in our
Privacy Policy.
8. Ending these terms
These terms apply until you or we end them.
If you break these terms, your right to use the services ends automatically.
When these terms end, you must stop using the app and delete all copies of it.
9. No warranty
Unless we say otherwise in writing, the services are provided "as is", without any promises, conditions or
warranties, whether stated or implied.
You use the app at your own risk. All risk as to its quality, performance and accuracy is yours.
Nothing we tell you, in writing or out loud, creates a warranty.
10. Limitation of liability
We are not responsible for any damage that comes from your use of the services, or from not being able to use them.
We are never liable for personal injury, or for any incidental, special, indirect or consequential damage, including lost
profits, lost data, business interruption or any other commercial damage or loss, however it is caused and even if we were told
it could happen.
In any case, our total liability to you for all damages is limited to US$50 (except where the law requires
otherwise in cases of personal injury). This limit applies even if a remedy fails of its essential purpose.
Nothing in these terms limits or excludes any right you have under consumer protection laws that cannot be limited or excluded
by agreement.
11. Changes to these terms
We may change these terms from time to time. Changes are published on our website and take effect when published.
Please check these terms regularly. If you keep using the app after a change is published, you accept the updated terms.
12. Transferring these terms
These terms are personal to you. You may not assign, transfer or sublicense them without our written permission.
We may assign, transfer or delegate our rights and obligations under these terms without your permission.
We may give you notices by email, in writing, or by posting them clearly on our website.
13. Governing law and courts
The laws of the Hong Kong Special Administrative Region of the People's Republic of China govern these terms and your use of
the app.
The courts of Hong Kong have exclusive jurisdiction over any claim or dispute with us or relating to your use of the app.
Other local, national or international laws may also apply to your use of the app.
